4. Matters arising from the Meeting of the Planning & Environment Committee held on 6 August 2020: The committee is asked to note the following responses from MSDC Planning Dept, forwarded by Cllr Alison Bennett:
a) 145 High Street Hurstpierpoint – As I understand the situation, work was required to be completed by the 17th June 2020 In respect of the matters approved under application DM/19/5209 and other outstanding matters associated with the Enforcement Notice that is currently in place. Obviously the pandemic will have had an impact on their ability to complete the works and before considering what further formal action may be appropriate, it would appear to me that it would be reasonable to agree a revised date for any outstanding works to be completed. I have asked that a visit to the site is arranged, to establish the current position and make contact with the owner to establish their intentions and to agree a revised date for completion.
b) Alders Farm. Brighton Road – It is correct that the temporary permission granted under DM/16/4199 has expired and the dwelling does not currently benefit from planning permission. While application DM/20/0585 was withdrawn by the applicants following concerns raised by the Council’s Agricultural Advisor, a new revised application has been submitted and is being considered under reference DM/20/2704. This application is currently being consulted upon and comments on the proposal from the Council’s Agricultural Advisor are awaited. These comments appear key in this case and the Council are unlikely to pursue formal enforcement proceedings while the outcome of the current application is unknown. The planning case officer and enforcement officers are working closely on this matter to resolve the current breach of planning control.

8.4 Appeals: to note planning appeals:

The role of the Planning Committee in planning decisions:
- The Planning Authority is Mid Sussex District Council or South Downs National Park Authority who have the final decision on whether planning permissions are granted or refused.
- The Parish Council is a Statutory Consultee, which means that MSDC or SDNPA must ask for its opinion and take it into account, but not necessarily follow its recommendation. (The Planning Authority can grant permission against the wishes of the Parish Council.)
- The Parish Council has delegated its decision-making to the Planning Committee, which is authorised to express the Council’s view. /
- The Committee should take account of local planning policies, as detailed in the MSDC Local Plan (2004) and the Neighbourhood Plan PARISH 2031. It can also take guidance from the Parish Council’s Design Statement.
- Members of the public attending Committee meetings are given the opportunity to speak on matters on the agenda but should follow the procedures set down in the Council’s Standing Orders.
