MINUTES of the meeting of the Planning & Environment Committee, held on Thursday 4th August 2022 at 7.30 pm at Conference Room, Village Centre, Trinity Road, Hurstpierpoint.

P&E22/23019 Declarations of Interest:  Cllr Helen Bedford declared a pecuniary interest in DM/22/1580 – Knowles Tooth Langton Lane, Hurstpierpoint, BN6 9EZ. Cllr left the room while the application was discussed.

P&E22/23020 Minutes of the Planning Committee meeting held on 7th July 2022: The committee reviewed the minutes and it was:

RESOLVED: That the Committee AGREED the Planning & Environment Committee minutes of 7th July 2022.

P&E22/23021 Matters arising from the meeting of the Planning Committee held on 7th July 2022: There were no matters arising.

P&E22/23022 Adjournment for questions from the public: Members considered whether to adjourn the meeting in order to receive questions from members of the public in attendance. No members of the public present.

P&E22/23023 Planning applications delegated to Committee Chairman and Vice-Chairman in accordance with Minute P17/048.  The following Applications were reported to the Committee and the Recommendations to the Planning Authority agreed:

(1) 9 Brown Twins Road Hurstpierpoint Hassocks West Sussex BN6 9XT. DM/22/2202. Oak – reduce crown by 2.5 -3 metres. Tree surgery.

RECOMMENDATION: Whilst in principal we wouldn’t object, there is insufficient information on the MSDC website to enable us to make an informed decision.

(2) Leigh Cottage Cuckfield Road Ansty Haywards Heath West Sussex RH17 5AL. DM/22/2159. 3 No. additional new roof dormer windows to be added to existing roof conversion. Lawful Development Certificate.

RECOMMENDATION: No comment

P&E22/23024 Applications – Committee decision: The Committee considered the following and made RECOMMENDATIONS to the Planning authority:

(1) Wolstonbury Farm New Way Lane Hurstpierpoint West Sussex. SDNP/22/03102/PA15B. Disconnection and removal of existing pole 632409 and connection onto the existing underground cable to provide an upgraded underground supply to Wolstonbury Farm.

RECOMMENDATION: Our recommendation is that MSDC should give permission

(2) Little Park Farm Marchants Close Hurstpierpoint West Sussex. DM/22/2131. Variation of Cond 2 in relation to DM/22/0204.

RECOMMENDATION: No further comment

(3) 3 Knowles Tooth Langton Lane Hurstpierpoint Hassocks West Sussex BN6 9EZ. DM/22/1580. Erection of an oak-framed garage with tiled roof instead of brick garage previously approved, plus erection of wooden pergola surrounding a half sunken swim lane with decking to level ground, plus steps. ADDITIONAL PLANS received 12/07/2022 showing further details of the pergola and swim lane.

RECOMMENDATION: No further comment

(4) 2 Layton Fields Close Hurstpierpoint Hassocks West Sussex BN6 9YH. DM/22/2175. Proposed loft conversion with front and rear dormers, installation of rooflights, floorplan reconfiguration and all associated works.

RECOMMENDATION: Our recommendation is that MSDC should give permission

(5) Torch Holiday And Retreat Centre Little Torch 4 Hassocks Road Hurstpierpoint Hassocks West Sussex BN6 9QN. DM/22/2188. Change the use from Class C2 to Class C3 to form 2no dwelling houses and 7no apartments, car parking and associated development.

RECOMMENDATION: No further comment

(6) Erskine Day Nursery Erskine Villa Brighton Road Hurstpierpoint Hassocks West Sussex BN6 9EF. DM/22/2041. Change of use of property Erskine day nursery / Villa, Hurstpierpoint BN6 9EF to become solely Erskine Day Nursery.

RECOMMENDATION: Our recommendation is that MSDC should give permission, although the committee have some concerns over the increase in traffic movements.

(7) Pook Bourne Stud Farm Pookbourne Lane Sayers Common West Sussex BN6 9HD. DM/22/2222. Proposed Exercise Area for Brood Mares.

RECOMMENDATION: Our recommendation is that MSDC should give permission.

(8) 8 Land To The North Of Lyndon Reeds Lane Sayers Common West Sussex. DM/22/0640. Hybrid application consisting of:- a) Full application for 36 one, two, three and four bedroom dwellings (including 30% affordable housing), associated infrastructure, landscaping, pedestrian and vehicular access from Reeds Lane and the demolition of Lyndon. b) Outline application for 2 three bedroom self/custom build plots. AMENDED PLANS received 19/07/2022 reducing overall number of units to 38, revising site layout, amending house types, boundary treatments, materials and phasing plan as well as updated Ecology and drainage strategy and flood modelling information, visibility assessment and swept path analysis.

RECOMMENDATION: We continue to recommend that this application be refused. The reduction of one unit makes no material difference to our concerns at a further imposition of significant housing upon a small village with little by the way of infrastructure. Our previous comments remain relevant, we fully support the continued objections from residents; over-development of the site, traffic and flooding issues.

(9) 7 Marchants Road Hurstpierpoint Hassocks West Sussex BN6 9UP.DM/22/2219. Retrospective application for single storey extension to rear of the property, two storey extension to East side, and newly-positioned front door/porch on the south side. To include a change in materials from DM/21/1873 to Cedral cladding and change in window colour.

RECOMMENDATION: Our recommendation is that MSDC should give permission.

(10) Bridgers Farm, Langton Lane, Hurstpierpoint DM/22/2304.  Replacement of Barn 2 (previously Barn 6) on a like for like basis, previously approved under DM/20/3882, from an open barn to a closed barn for Office/Storage/Light Industrial Use.

RECOMMENDATION: Our recommendation is that MSDC should give permission.

(11) Bridgers Farm, Langton Lane, Hurstpierpoint DM/22/2306.  Replacement of Barn 1 (previously Barn 3) from that previously approved under DM/20/3882 to Office/Storage/Light Industrial Use.

RECOMMENDATION: Our recommendation is that MSDC should give permission

(12) 24 Kemps, Hurstpierpoint DM/22/1800.  Proposed new 3 bedroom dwelling.  Amendments to existing dwelling to include a new pitched dormers to front and rear, removal and repositioning of existing windows and incorporating attached store in the kitchen.

RECOMMENDATION: Our recommendation is that MSDC should refuse the application. Thesite is situated on a narrow footpath with no vehicular access to its immediate vicinity, and any new building will only add to existing on-street parking problems. Should Planning Approval be given, we have major concerns as to the delivery of construction materials etc.  There are already problems and damage being caused by HGV’s entering Sunleigh Court because Satnavs and signage wrongly indicate vehicle access to Kemps.  Whether delivery vehicles use Kemps or Sunleigh Court materials can only be offloaded away from the site and will then have to be manually moved via the footpath, something that will be particularly difficult in the case of e.g. Roof trusses and Steels.  Not only will this present a hazard to pedestrians, but re Sunleigh Court it might well block vehicle access to residents.  We strongly urge that this aspect is taken into account when considering this application.

(13) Box House Poultry Farm Albourne Road Hurstpierpoint. DM/22/0541. Application Type: Removal/Variation of Condition Proposal: Variation of condition 3 attached to planning references HP/044/79, 07/1768/FUL and 14/02271/FUL which specifies the buildings shall be used for storage purposes only for Benfell Farm produce only and to allow the buildings to be for storage, distribution, office and retail in relation to St Peter and St James Hospice and workshops for upcycling furniture to sell in shops. The site would be in use between 9am-5pm Monday to Friday.

RECOMMENDATION: Our recommendation is that MSDC should give permission.

P&E22/23025 Licencing Applications – Committee Decision: The Committee is asked toconsider the following and make RECOMMENDATIONS to the Licencing Authority:

8.1 Village Pizza Kitchen, 126C High Street, Hurstpierpoint, BN6 9PX. LI/22/1153. New Premises Licence Application.

RECOMMENDATION: Our recommendation is that MSDC should give permission.

P&E22/23026 MSDC Planning Decisions: (All as H&SC PC recommendation, except where noted).

f) Heathland 5 Albert Silsby Place Hurstpierpoint Hassocks West Sussex BN6 9YG. DM/22/1595. Variation of condition 2 relating to planning reference DM/21/3265 to allow for amendments to the design.

g) 9 Marchants Road Hurstpierpoint Hassocks West Sussex BN6 9UP. DM/22/1724. Partial demolition of existing workshop to rear of detached garage. Construction of a single-storey kitchen extension to the rear elevation. Construction of a single-storey Porch/WC extension to the front and side elevations. i) The Manor House 3 Albert Silsby Place Hurstpierpoint Hassocks West Sussex BN6 9YG. DM/22/1569. Construction of single storey Gym with timber weatherboarding/brick plinth and plain clay tile roof. l) Mid Sussex District Council Trinity Road Car Park Trinity Road Hurstpierpoint West Sussex. DM/22/1839. Sequoiadendron giganteum – Arbortrack REF: 09QU – Section fell down to as close to ground level as possible and remove stump.
